
Abdul Jabbar Mohd Sulaiman, 57, pleaded not guilty to the charges under the Communications and Multimedia Act (CMA) 1998 at the Sessions Court here today.
He was charged with using a Panasonic KX-TG4741 DECT cordless phone (base), paired with four KX-TGA470 cordless phones, illegally. The phones are not certified to be used in Malaysia.
Jabbar was charged with using the Panasonic cordless phone as his land line at 5, Jalan Desiran Tanjung 5, Seri Tanjung Pinang, Tanjung Tokong, here on Feb 24, 2016.
He was charged under Section 238 (1) of the CMA Act and the Rules 16 (1) and 16 (3) of the MCMC (Technical Standards) Regulations 2000.
These laws make it illegal for a person to use an uncertified phone that emits radio frequencies and be in possession of such a device.
Jabbar has been charged with three counts of using an uncertified phone, an offence which carries a RM50,000 fine or one years’ jail each; and another two counts of being in possession of uncertified communications equipment, an offence which carries a RM100,000 fine and six months’ jail sentence each.
Deputy public prosecutor Mohd Sophian Zakaria prosecuted while S Raveentharan appeared for Jabbar.
Raveentharan told the court the phone was presented to him by a friend in Singapore and he was not aware it was not certified for use.
Judge Norsalha Hamzah then set Jan 16 for mention, pending tendering of further documents related to the case.
