A group dedicated to seeking justice for the late political aide Teoh Beng Hock has urged the police to investigate 10 Malaysian-Anti Corruption Commission (MACC) officers for various offences under the Penal Code, including murder.

Teoh Beng Hock Trust for Democracy spokesman Ng Yap Hwa said the officers should be investigated for covering up Teoh’s death, abetting and attempting to cover up his death, giving false evidence and destroying evidence, among others.

In a police report lodged at the district police headquarters here this morning, Ng urged Inspector-General of Police Abdul Hamid Bador to investigate and charge the 10.

In 2009, Teoh, who was the political aide to then Selangor executive councillor Ean Yong Hian Wah, was found dead on the fifth floor of Plaza Masalam in Shah Alam, hours after he was interrogated by Selangor MACC at its office on the 14th floor of the same building.

A royal commission of inquiry concluded that Teoh was driven to suicide by the aggressive interrogation methods used by MACC officers. It also blamed three officers for their aggressive methods which it said had violated procedures.

The trust has identified the additional seven officers based on submissions to the Bar Council from 2011, including the former Selangor MACC deputy chief and the investigations chief.

Ng said his group was dissatisfied that government agencies had been “pushing the ball to each other without accountability”.

He also noted that Home Minister Muhyiddin Yassin had said the attorney-general would respond to the issue.

“However, a few weeks ago, AG Tommy Thomas told Teoh’s sister, Lee Lan, that it is the responsibility of the police to probe the case and determine the investigation direction,” he said.

According to Ng, MACC chief Latheefa Koya had also refused to initiate internal disciplinary action against her officers, saying that it was the duty of the police to probe those allegedly involved.

The police received instructions from the Attorney-General’s Chambers last year to conduct further investigations into Teoh’s death after Pakatan Harapan took over the government.

However, they are investigating the incident under wrongful confinement and not culpable homicide, even after the Court of Appeal overturned the coroner’s open verdict in September 2014 and ruled that Teoh’s death was caused by a fall as a result of, or accelerated by, an unlawful act or acts of persons unknown.

Today, Ng also handed over to the police evidence from all the court findings on Teoh’s death, including from the 2009 inquest and the Court of Appeal judgment.

With the fresh report, he said the IGP should call for a new investigation under Section 302 (for murder) or 304 (culpable homicide) of the Penal Code.
