Mahdzir to be recalled in Rosmah’s trial after quarantine ends

Former education minister Mahdzir Khalid could not turn up at the High Court today to testify in Rosmah Mansor’s corruption trial as he is still under quarantine for Covid-19.

Ad-hoc prosecutor Gopal Sri Ram told High Court judge Mohamed Zaini Mazlan that Mahdzir had been placed under a home surveillance order (HSO) by the health ministry.

The ministry, in its notice, stated Mahdzir had to be placed under HSO as he was in close contact with a Covid-19 patient.

“I was told that he is going for his third test on Wednesday and the result will be out on Thursday.

“So, the prosecution seeks the court’s indulgence to take this case to next Tuesday (Oct 13) afternoon, to have the witness (Mahdzir) complete his cross-examination and for us to close our case,” he said, adding Mahdzir’s quarantine period ends on Oct 12.

Rosmah’s lawyer Jagjit Singh told the court he needed to check his diary on whether he was available next week to cross-examine Mahdzir and would inform the court on Tuesday.

The defence is seeking to recall Mahdzir to the witness stand to clarify certain issues. Previously, Mahdzir had told the court that he was pressured by Rosmah to award the RM1.25 billion solar hybrid project in Sarawak to Jepak Holdings Sdn Bhd.

He insisted he did not accept any bribe from Jepak Holdings managing director Saidi Abang Samsudin for the project.

Meanwhile, the prosecution called its last witness, Malaysian Anti-Corruption Commission (MACC) investigating officer Noornabilah Mohd Aziman, to testify. She had begun investigations into the case in November 2018.

She said the agency found evidence that Rosmah had solicited and accepted bribes for the RM1.25 billion project.

“My colleague (Mohd Shukri Mohd Said) gave me instructions to start investigations against her based on the other case’s findings,” she said, without disclosing what “other case” she was referring to.

Noornabilah also said she obtained relevant documents from the education ministry, finance ministry, Jalan Medan Tuanku Maybank branch, as well as the Bintulu CIMB branch.

“Besides that, another officer (Nik Lokman Hakim Nik Mohd Nor) also passed me a recording on a purported conversation between Datin Seri and Datuk Seri Najib (Razak) on Feb 9,” she added.

The court previously heard the recording when Mahdzir and Rosmah’s former officer Rizal Mansor testified. Both men confirmed Rosmah and Najib were the individuals in the recording.

The hearing continues before Zaini tomorrow.

Rosmah is facing three counts of corruption charges for allegedly soliciting RM187.5 million from Saidi as an inducement to help Jepak Holdings secure the Hybrid Photovoltaic Solar System Integrated Project and the maintenance and operation of Genset/Diesel for 369 rural schools in Sarawak.

The education ministry project, awarded through direct negotiations, is worth RM1.25 billion.

Rosmah is also accused of receiving bribes amounting to RM6.5 million from Saidi between 2016 and 2017.
