Ramkarpal Singh says the menteri besar may have committed an offence under Section 504 of the Penal Code which deals with intentional insult with intent to provoke breach of the peace.

GEORGE TOWN:
Kedah menteri besar Muhammad Sanusi Md Nor can be investigated by police for allegedly causing public outrage over his remarks on containers for the Covid-19 dead, which can be considered an insult on others, a lawyer said today.

Ramkarpal Singh said while the menteri besar had defended himself by saying the remarks were made to reporters, Sanusi should know that such remarks can be cited in their news reports.

He said Sanusi’s remarks – “We have enough containers for the dead, who wants to go in can give their names.” – were insensitive and could cause provocation as deaths from the disease have risen frighteningly recently.

Ramkarpal said Sanusi should be investigated by police the same way that four people were arrested and questioned for insulting him on Facebook.

“The only questions that remain is whether the menteri besar intended to provoke others with his remarks and whether he knew this was likely to cause them to commit an offence.

“[..] it is a matter for the police to investigate despite his claim that it was a mere joke, the same way others are being investigated for their comments on his remarks.

“In light of the above, it is possible that the Kedah MB may have committed an offence under Section 504 of the Penal Code. The only way to determine this is by summoning him for the purpose of investigations,” he said in a statement.

Section 504 deals with an offence of intentional insult with intent to provoke a breach of the peace.

Ramkarpal also asked if the police would pick the menteri besar up in the wee hours of the morning and later seek a remand order before a magistrate, like they did with some of those they arrested.

“He is not above the law and the police must also be seen to be acting without fear or favour,” he said.

Last night, five police reports were also lodged at the Bukit Mertajam police station by Batu Kawan DAP Socialist Youth members over Sanusi’s remarks.

FMT has tried to contact Sanusi for comment.
