Norhayati Mohd Ariffin is seeking leave to initiate a judicial review in an attempt to set aside several provisions in the Official Secrets Act (OSA), under which the report has been classified.
She also wants the court to declare as unconstitutional the government’s decision to classify as secret a report by the special task force on Amri and Pastor Raymond Koh’s disappearance.
“The task force report concerns the conduct of police officers as well as the manner in which they carried out their duties in relation to the abduction of Amri and Pastor Koh.
“These are matters of public interest especially in light of the findings made by Suhakam (Human Rights Commission of Malaysia) in the commission’s report,” Norhayati said in her application.
She added that she only found out that the task force report was a government secret during the course of her civil lawsuit against the police and government.
Norhayati named Mohd Russaini Idrus, a secretary in the Police Force Commission, as well as the government in her legal challenge.
High Court judge Wan Ahmad Farid Wan Salleh will hear the application on Jan 12.
Suhakam held a public inquiry into Koh and Amri’s disappearance between 2017 and 2019.
Amri, who was the founder of the NGO Perlis Hope, left his home in Kangar around 11.30pm on Nov 24, 2016. His car was later found at a construction site of the Bukit Cabang Sports School in the wee hours of the following day.
In 2019, the Suhakam inquiry concluded that Amri was a victim of enforced disappearance.
In response, the home ministry established a task force to look into Suhakam’s conclusions. It was given six months to complete its report.
Since then, neither the ministry nor the task force have released a report, despite repeated calls to do so by various parties, including Suhakam and other NGOs.
