
Delivering her grounds orally, judge Nor Hasniah Abdul Razak said the prosecution failed to establish a prima facie case against Dayalan, the chairman of the Malaysia-Singapore Workers Task Force (Pemas).
Five witnesses gave evidence for the prosecution.
Hasniah also ordered the RM3,000 bail amount to be returned to Dayalan, 44.
Dayalan was charged with knowingly making and initiating the transmission of offensive communications on Facebook at 10.03pm on May 30, 2021, with the intention to annoy others.
According to the charge, the post was read at Bukit Aman’s commercial crime investigation department at Menara KPJ in Wangsa Maju at 7.15pm on June 2.
The charge was framed under Section 233(1)(a) of the Communications and Multimedia Act 1998, which provides for a maximum fine of RM50,000 or imprisonment for up to one year or both if convicted.
